The Catalan government has approved in the Governing Council of 5 April 2011, the Draft Law on Regulation of inheritance tax benefits are treated in other areas of the state, especially i Madrid Valencia.
Following the adoption of this draft law, which shall enter into force for the purpose of January 1, 2011, the tax position of the Catalans will be similar with respect to citizens of other regions.
The Government's objective is to eliminate tax competition between regions in this area to prevent the relocation and building trust with the implementation of commitments made.
The amendment approved by the government subsidy will mean 99% of tax liability for taxpayers of kinship groups I and II (children, parents and spouses). As for the reductions, the third phase of tax reform of 2009, due to come into force on July 31, 2011, will take effect January 1 this year.
From the point of view of collection, the government says the impact will be insignificant. With the new reform, the Government expected to enter 156.2 million euros in 2012, compared with 258.6 million that had been raised with the norm until now. Therefore, the tax adjustment approved today, the Government will only raise 102.4 million euros.
However, the tax liability of the heirs that the deceased died before December 31, 2010, be required to make the payments provided before the change of the tax.
